Article 27 of the 1917 Mexican Constitution prohibits foreigners from directly acquiring land or waterways located within 100 kilometers (62 miles) of any national border and within 50 kilometers (31 miles) of any coastline. These areas are known as “Restricted Zones.”
Since 1973, an amendment known as the Foreign Investment Law, under Article 11, has allowed foreigners to acquire rights over real estate located in the “Restricted Zone” through a trust (fideicomiso) established with a Mexican bank. This legal instrument ensures the foreign buyer enjoys possession rights and related privileges.
When a foreign buyer wishes to use or develop a property, they may instruct the bank to purchase and manage it through a fideicomiso. Authorization from the Mexican Ministry of Foreign Affairs (Secretaría de Relaciones Exteriores) is required pursuant to Article 11, and Article 13 of the Foreign Investment Law provides that a fideicomiso may last up to 50 years, renewable for an additional 50-year term.
When property is acquired through a fideicomiso, the bank becomes the legal owner; however, it must act according to the terms and clauses of the trust agreement set by the foreign beneficiary (fideicomisario). These provisions guarantee possession and enjoyment of the property, granting rights to use, lease, sell, or transfer it to a third party.
